Arizona follows a pure comparative fault doctrine — one of the most claimant-friendly rules in the country.

How it works A jury assigns a percentage of fault to each party. Your recovery is reduced by your share. If you were 30% at fault and your damages are $100,000, you recover $70,000.

Why this matters In states with modified comparative fault, being 50% or 51% at fault bars recovery entirely. Arizona has no such cutoff — even an 80%-at-fault claimant can still recover 20%.

Common misconceptions Many injured Arizonans assume they have no case because they were partly responsible. Don't make that mistake. Always have a lawyer evaluate the facts.
